Delayed flight
According to the decision of the Court of Justice of the European Union of 19 November 2009 in Joined Cases C-402/07 and C-432/07, passengers whose flights are delayed may rely on the right to compensation provided for in art. 7 of Regulation (EC) No 261/2004, where they reach their final destination three or more hours after arrival time originally scheduled by the air carrier.
So, if the delay extends over 3 hours and there was no emergency situation, independent of the air carrier - the passengers whose flights are delayed are entitled to the compensation amounting:
250 EUR for flights shorter than 1500 km,
400 EUR for intra-Community flights longer than 1500 km and all other between 1500 and 3500 km,
600 EUR for all other flights.
In calculating the time of delay, we consider the time of reaching the destination airport.
