Delayed flight

According to the decision of the Court of Justice of the European Union of 19 November 2009 in Joined Cases C-402/07 and C-432/07, passengers whose flights are delayed may rely on the right to compensation provided for in art. 7 of Regulation (EC) No 261/2004where they reach their final destination three or more hours after arrival time originally scheduled by the air carrier.


So, if the delay extends over 3 hours and there was no emergency situationindependent of the air carrier the passengers whose flights are delayed are entitled to the compensation amounting:

  • 250 EUR for flights shorter than 1500 km,

  • 400 EUR for intra-Community flights longer than 1500 km and all other between 1500 and 3500 km,

  • 600 EUR for all other flights.

In calculating the time of delaywe consider the time of reaching the destination airport.
